1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Sou mobile application ("Sou" or the "App"), operated by Sou Apps ("Sou Apps", "we", "our", or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Sou is a menstrual cycle and wellness tracking application designed to help users record, monitor, and better understand information related to their menstrual cycles, symptoms, and overall wellness. We may modify, update, suspend, or discontinue any part of the App at any time. Where changes materially affect paid features, we will provide reasonable notice where possible.

3. Medical Disclaimer

Sou is provided for informational and wellness purposes only. The App does not provide medical advice, diagnosis, or treatment, and is not a medical device.

Cycle predictions, fertility estimates, symptom insights, reminders, and any other information generated by the App are estimates based on the information you provide. They may be inaccurate and must not be relied upon for medical decisions, including contraception or family planning. Always consult a qualified healthcare professional regarding any health-related questions or concerns. Never disregard professional medical advice or delay seeking it because of information provided by the App.

4. Eligibility

You must be at least 13 years old (or the minimum age required by the laws of your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. Your Account

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may delete your account at any time from within the App's settings. Please notify us at hello@souapps.com if you suspect unauthorized use of your account.

6. User Data and Content

You retain full ownership of the information and content you submit to the App. By providing such information, you grant Sou Apps a limited, non-exclusive license to process, store, and use it solely for the purpose of operating, maintaining, securing, and improving the App, in accordance with our Privacy Policy. You are responsible for the accuracy and lawfulness of the information you provide.

7. Privacy

Your use of the App is subject to our Privacy Policy, available at https://souapps.com/privacy-policy, which explains how we collect, use, store, and protect your information. By using the App, you acknowledge that you have read and understood our Privacy Policy.

8. Subscriptions, Purchases, and Payments

Certain features of the App may require a paid subscription or one-time in-app purchase. Where applicable:

• Prices, billing periods, and subscription details will be clearly presented within the App before purchase.

• Payment will be charged to your Apple ID account at confirmation of purchase.

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

• You can manage and cancel your subscriptions at any time in your App Store account settings after purchase.

• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

• All payments, renewals, and refunds are processed by Apple and are subject to the App Store's terms and policies. Refund requests should be directed to Apple through the App Store.

9. Acceptable Use

You agree to use the App only in accordance with these Terms and all applicable laws and regulations. You may not:

• Misuse, disrupt, or interfere with the operation or security of the App

• Attempt to gain unauthorized access to the App, its servers, or related systems

• Reverse engineer, decompile, or disassemble the App, except where permitted by law

• Use the App in any way that could damage, disable, overburden, or impair the service

• Use the App for any unlawful, harmful, or fraudulent purpose

10. Intellectual Property

The App, including its software, design, trademarks, logos, graphics, content, and related materials, is owned by or licensed to Sou Apps and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. No ownership rights are transferred to you through your use of the App.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Sou Apps disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of security vulnerabilities.

12. Limitation of Liability

To the maximum extent permitted by law, Sou Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of or inability to use the App. In no event shall our total aggregate liability exceed the amount you paid to us for the App or related services during the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars (USD $50) if you have made no such payments. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Sou Apps and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms or misuse of the App.

14. Termination

We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms, or if necessary to protect the App, its users, or our business interests. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Sections 3, 10, 11, 12, and 13) will survive.

15. Apple-Specific Terms

These Terms are between you and Sou Apps only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. Changes become effective upon publication within the App or on our website, and the "Last Updated" date will be revised accordingly. Where changes are material, we will provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Nothing in these Terms deprives you of mandatory consumer protections under the laws of your country of residence.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sou Apps regarding your use of the App and supersede all prior agreements, understandings, and communications relating to the App. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
